WHAT WE COLLECT

From time-to-time, we collect and store the following information:

  • Personal Information including your name, contact information including email address, physical address, phone number and financial information;
  • Sensitive information including government identifiers such as TFN, Passport, nationality, date of birth, country of birth.
  • Demographic information including country and state.

As part of our recruitment processes for employees and contractors, we collect and store:

  • Personal Information including names, addresses and other contact details, dates of birth, financial information, citizenship, employment references, regulatory accreditation, media, directorships, property ownership and driver’s license information.
  • Sensitive Information including government identifiers (such as TFN, Passport), nationality, country of birth, professional memberships and criminal records.
  • Health Information (particularly in relation to staff and prospective staff records) including medical records, disabilities, immunisation details and psychological reports.

Generally, we will seek consent from the individual in writing before we collect their sensitive information (including health information).

It should be noted that employee records are exempt from the Australian Privacy Principles where they relate to:

  • current or former employment relations between Dry Kirkness and the employee; or
  • an employee record held by Dry Kirkness relating to the individual.

WHAT WE DO WITH THE INFORMATION WE GATHER 

We require this information to understand your needs, provide you with our services, and for the following reasons:

  • Providing one or more of our services to you;
  • improving our services;
  • Periodically sending promotional emails about new products, special offers or other information we think you may find interesting, using the contact details you have provided;

Personal information about an individual may be disclosed to an overseas organisation in the course of providing our services, for example when storing information with a “cloud service provider” which stores data outside of Australia.

  • We have satisfied ourselves that the overseas recipient is compliant with the APPs, or a similar privacy regime

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

QUALITY OF PERSONAL INFORMATION

We take all reasonable steps to ensure the personal information we hold, use and disclose is accurate, complete and up-to-date. If we become aware that the Personal Information is incorrect or out of date, we will take reasonable steps to rectify that information.

ACCESS AND CORRECTION OF PERSONAL INFORMATION 

You can submit a request to us to access the personal information we hold relating to you, or request that we change your personal information. If we receive such a request, we will take reasonable steps to verify your identity before granting access or correcting the information. Should we not be able to verify your identity, we trust you will understand our right to reject your request.

COMPLAINTS

You can make a complaint about how Dry Kirkness manages your personal information, including a breach of the APPs by notifying us in writing as soon as possible.  We will respond to the complaint within a reasonable time (usually no longer than 30 days) and we make seek further information in order to provide a full and complete response.

Dry Kirkness does not charge a fee for the handling of complaints.

If you are not satisfied with our response, you may refer the complaint to the OAIC. A complaint can be made using the OAIC online Privacy Complaint form or by mail or email.

A referral to OAIC should be a last resort once all other avenues of resolution have been exhausted.
